These Terms & Conditions ("Terms") govern your access to and use of QuinPick ("QuinPick," "we," "us," or "the Service"), including our website, progressive web app, and related services.

By creating an account, joining a league, or otherwise using QuinPick, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

QuinPick is a free, private score-prediction tool intended for friends and family leagues around sporting events such as the FIFA World Cup. We provide scheduling, pick entry, scoring, leaderboards, and optional tools for league organizers to share payment instructions and review uploaded proof images.

QuinPick is not a gambling platform, sportsbook, lottery, or wagering service. We do not offer odds, take bets, or operate pools on our own behalf. Any optional buy-in or prize pool is a private arrangement among participants in a league—not a QuinPick product or offering.

You must be at least 18 years old—or the age of majority where you live, whichever is higher—to create an account and participate in any league that involves money.

You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate profile information and notify your league organizer if your access is compromised.

We may suspend or terminate accounts that violate these Terms, abuse the Service, or create legal or security risk.

QuinPick does not collect, transmit, store, or refund money on behalf of users. We do not charge subscription fees or transaction fees for use of the Service.

Payment links, QR codes, phone numbers, and similar details shown in the app are supplied by league commissioners or members. QuinPick merely displays that information to facilitate direct peer-to-peer payments outside the app.

All financial transactions—including buy-ins, verification, and payouts—occur solely between participants and their chosen third-party payment providers. QuinPick is not a party to those transactions and assumes no liability for missed payments, duplicate payments, fraud, disputes, taxes, or failure to distribute winnings.

Commissioners and participants are solely responsible for complying with applicable laws, including rules on private contests, gambling, money transmission, and tax reporting in their jurisdiction.

You agree not to misuse QuinPick. Prohibited conduct includes, without limitation: uploading false or misleading payment proofs; impersonating another person; harassing or threatening other users; attempting to bypass pick locks or access controls; scraping or reverse-engineering the Service; introducing malware; or using QuinPick for unlawful commercial gambling operations.

You retain responsibility for content you submit (display names, picks, payment proofs, and messages). Do not upload content you lack rights to share.

QuinPick and its branding, design, code, and original content are owned by the Service operator or its licensors. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial league participation.

Team names, flags, and event marks may belong to third parties. QuinPick does not claim ownership of third-party trademarks.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF SCORES OR FIXTURES, AND NON-INFRINGEMENT.

Match data may be delayed or incorrect. Scoring and leaderboard results are provided for entertainment among private leagues. We do not guarantee uninterrupted or error-free operation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUINPICK AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $0 OR (B) THE AMOUNT YOU PAID TO QUINPICK IN THE TWELVE MONTHS BEFORE THE CLAIM. BECAUSE QUINPICK IS FREE, THAT AMOUNT IS TYPICALLY ZERO.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless QuinPick, its operator, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: your use of the Service; your league's buy-in or payout arrangements; content you submit; your violation of these Terms; or your violation of any law or third-party right.

You may stop using QuinPick at any time. We may suspend or terminate access, with or without notice, for conduct that violates these Terms or harms the Service or other users.

Sections that by their nature should survive termination—including payment disclaimers, disclaimers of warranty, limitation of liability, and indemnification—will survive.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree to an update, stop using the Service.

These Terms are governed by the laws applicable where the Service operator is located, without regard to conflict-of-law rules.

Before filing a formal claim, you agree to contact us and attempt in good faith to resolve the dispute informally. Except where prohibited, you and QuinPick agree that any dispute will be brought on an individual basis and not as a class or representative action.

Nothing in these Terms prevents either party from seeking injunctive relief for misuse of the Service or intellectual property.
